CONSTITUTION Memorandum, Rules & Bye Laws of the ALL INDIA FEDERATION of DIPLOMA ENGINEERS Part – I MEMORANDUM OF THE FEDERATION

Part - I

CLAUSE Details
1 Name :
The name of the Federation shall be
ALL INDIA FEDERATION OF DIPLOMA ENGINEERS” (with AIFODE as its abbreviation) herein after called “The Federation”.
2 Office :
(a) The Central Office of the Federation shall be located at “Dutt Bhawan”, New Ashok Nagar, Near Metro Station, P.O- Vasundhara Enclave, Delhi-110096.
(b) The office of various Office-bearers shall be located at their respective Head Quarters as their camp office. Except the President, General Secretary, Addl. General Secy., Finance Secy., Editor who will attend the Central Office for at least a week every month with the consent of President & Secy. General.
3 Aims and Objects :
The Aims and Objects of the Federation shall be:
  • To uphold in everyway the dignity and honour of the Engineering Profession.
  • To promote a sense of spirit decorps amongst all Diploma Engineers.
  • To enable members to take counsel together on matters affecting their profession.
  • To elevate Engineering Profession and to raise the standard of the profession particularly for Diploma Engineers.
  • To strive to bring about a more uniform system of Technical Education and Examination.
  • To promote and provide for welfare and give relief by grants and or otherwise as the Federation may think fit.
  • To strive for solving the unemployment problem of Diploma Engineers.
  • To work in co-operation with others to promote integrity for Nation’s well being.
  • To strive to bring about economy in the implementation of the schemes.
  • To work for the abolition of compartmentalism in Engineering Education, Engineering Services and thus to achieve equality amongst all the members of the Profession.
  • To improve the service conditions of Diploma Engineers.
  • To extend unity & solidarity with the Diploma Engineers of other Nations in an Afro Asian & global context.
4 Methods :
For attainment and furtherance of these aims and objects, the Federation may –
  • Hold periodical Meetings and Conferences of the Members of the Federation and the Engineering Professionals in general.
  • Arrange from time to time Congresses, Conferences, Lectures, Discussions, Demonstration and National and International Conventions on any aspect of the Engineering and allied sciences.
  • Publish and circulate Journal which shall be the official organ of the Federation of a character specially adapted to the needs of the Engineering professions in India and which shall undertake publicity of the Federation through its columns and publish other literature in accordance with the aims & objects of the Federation.
  • Maintain a Library and an Office.
  • Publish from time to time papers embodying Engineering Researches conducted by the members or under the auspices of the Federation.
  • Encourage Research in Engineering and allied sciences with grants out of the funds of the Federation by the establishment of prizes or rewards and in such other manner as may from time to time be determined by the Federation.
  • Conduct campaign to educate people in India in the matter of economic execution of works or manufacturing of machineries and allied parts of engineering interest.
  • Consider and express its views on all questions affecting the Engineering profession, Engineering education and initiate taking such steps and adopting such measures as may deem necessary.
  • Organize Engineering corps for providing relief in times of Emergency.
  • Purchase, take lease of or otherwise acquire, hold, manage, let, sell, exchange, mortgage or otherwise dispose off movable or immovable property of every description and all rights or privileges necessary or convenient for the purpose of the Federation.
  • Erect, maintain, improve or alter and keep in repairs any buildings for the purpose of the Federation.
  • Raise funds in such manner as the Federation may deem fit and collect subscription and donation for the purpose of the Federation.
  • Invest any money of the Federation not immediately required for any of its objects in such manner as may from time to time be determined by the Federation.
  • Assist, subscribe to, co-operate with, affiliate or be affiliated to with any other public body whether incorporated, registered, recognized and having altogether or in part objects similar to those of the Federation.
  • Create or assist in creating branches for any of the purposes aforesaid.
  • Do all such things as are cognate to the objects of the Federation or are incidental or conducive to the attainment of the above objects.
  • Approach Central Govt., other Authorities etc. and various State Governments from time to time for attainment of the aforesaid objects.

Part - II

CLAUSE Details
1 Name :
The name of the Federation shall be

  • Raise funds via subscriptions, donations, investments, and other means as deemed fit.
  • Collaborate or affiliate with similar public bodies.
  • Create branches to advance Federation objectives.
  • Take necessary actions conducive to Federation’s objectives.
  • Approach Central & State Governments and other Authorities to further objectives.
7 Procedure for Membership :
Eligible constituents as per Article 2(a), 2(b), 2(c) may apply to the Secretary General using prescribed form with Rs.1500 admission fee. Membership will be issued jointly by President & Secretary General after E.C. approval.
8 Chief Patron and Patrons :
The Council may invite renowned personalities from India as Chief Patrons or Patrons to support Federation’s objectives.
9 Honorary Counselors :
Persons may be invited as Honorary Counselors by E.C. for their valuable services; they will not vote or hold office.
10 Federation Year :
The Federation’s financial year shall follow the calendar year.
11 Subscription :
All constituents shall pay annual subscription as prescribed in Bye-Laws.
12 Central Fund Contribution :
Constituents shall contribute to the Central Fund as determined by E.C.
13 Privileges of Constituents :
  • Receive Federation Journal and Publications.
  • Participate in all meetings, lectures, demonstrations subject to dues clearance.
  • Enjoy privileges conferred by Federation.
14 Administrative Set Up :
The supreme body shall be the Council consisting of elected or nominated members from constituents (Councilors).
15 Council :
Council composed of Presidents, Vice Presidents & Secretary Generals of state constituents based on member strength. Additional representatives may be nominated for each 1000 members. Councilor fees Rs. 200/- per meeting (or as revised).
16 Secretariat :
Secretariat consists of:
  1. President - 1
  2. Senior Vice President - 1
  3. Vice Presidents - 4 (Central, State, Electricity Board, Autonomous Bodies)
  4. Secretary General - 1
  5. Additional General Secretary - 1 (Central Office)
  6. Secretaries - 4 (as per 4 wings)
  7. Finance Secretary - 1
  8. Editor - 1
  9. Auditor - 1
  10. Zonal Secretaries - 8 (regional zones)
17 Terms of Office of the Council :
Council term: 2 years; may be extended by E.C. for max 6 months if required.
18 Annual Meeting of the Council :
Held annually at rotating venues as decided by Executive Committee.
19 Powers and Functions of the Council :
  • Administer Federation affairs per Memorandum, Rules, and Bye-Laws.
  • Delegate powers to Executive Committee except rule changes.
  • Appoint committees and delegate powers.
  • Elect/appoint Office Bearers.
  • Decide on matters beyond Rules/Bye-Laws.
  • Write off subscription arrears as needed.
20 Business of Annual Meeting of Council :
  1. Elect Chairperson if necessary.
  2. Adopt Annual Reports & Audited Accounts.
  3. Approve Budget.
  4. Consider rule amendments & resolutions.
  5. Handle State/Territorial resolutions.
  6. Other business permitted by Chairperson.
21 General Rules for Council Meetings :
  • Resolutions require prior notice (15 days before meeting).
  • Chairman may allow late resolutions.
22 Special Meetings :
May be called by Executive Committee or 1/3 members requisitioning it.
23 Notice of Council Meetings :
One month notice specifying place, date, time & agenda.
24 Quorum for Council Meetings :
Minimum 1/3rd members.
25 Executive Committee :
Term 2 years; may extend for 6 months if required.
26 Composition of Executive Committee :
  • Secretariat
  • Constituent Presidents/Secretaries
  • Outgoing President/Secretary General (advisors)
  • Committee chairpersons & conveners
  • 5 nominated invitees (approved by E.C.)
27 Powers and Functions of Executive Committee :
  • Implement Council policies.
  • Regulate offices, libraries, publications, property.
  • Appoint/remove committees/employees.
  • Negotiate with Governments & bodies.
  • Handle membership issues & disciplinary matters.
  • Recommend rule amendments.
  • Exercise all necessary powers.
28 Meetings of Executive Committee :
  • Quarterly meetings.
  • 1 month notice (15 days emergency).
  • 33% quorum.
  • Members missing 2 consecutive meetings may be replaced.
29 Secretariat Meetings :
  • Called by Secretary General with President’s consent.
  • 15 days notice and 33% quorum needed.
30 Journal :
Managed by Editor with Journal Committee assistance.
31 All India Conference :
Held every 2 years or as decided by Council/E.C. Constituents may host.
32 Amendments :
Constitution, Rules, Bye-Laws may be amended in Council or General Council Meeting.

Part - III

CLAUSE Details
1 Membership :
  • Membership shall be awarded as per Rule-2(a), 2(b) & 2(c) of Part – II.
  • Every Constituent eligible for membership as per Act-2(a), 2(b) & 2(c) and desirous of joining the Federation shall apply on the prescribed form to the Secretary General of the Federation along with Admission Fee of Rs. 1,500.
The membership order shall be issued under the joint signature of the President & Secretary General after the approval of the E.C.

  • Membership of a constituent shall be effective from the date it is informed of its Admission to the federation by the Secretary General. In the event of admission being refused, the fee received from the applicant shall be refunded.
  • A Constituent shall cease to be a member if it fails to pay the subscription for two consecutive years if so desired by the Executive Committee.
  • A constituent may withdraw its Membership by a written communication to the President who shall place it before the Executive Committee. After satisfying all dues of the Federation are paid by the Constituent, the Executive Committee may accept the withdrawal.
  • A constituent shall cease to be a member for such period as the Council may decide, if, in the opinion of that body, as decided by majority, its conduct has not been in keeping with the objects of the Federation.
  • A constituent ceasing its membership under the above mentioned clause shall be eligible for readmission with the approval of the E.C if it pays all arrears of subscriptions as due from it and a reinstatement fee of Rs. 1000/-
  • The Secretary General shall maintain a register of all Constituents of the Federation containing names and addresses of the Constituents and their representatives to Executive Committee. This Register will remain open for inspection during working hours by any representative of the constituents or any office bearers of the Federation.
2 Admission Fee :
The Constituents eligible for Membership of the Federation and desirous of joining the Federation while applying in the prescribed form to the Secretary General shall pay an admission Fee of Rs. 1500/-.
3 Subscription :
  • The Annual Subscription shall be on the basis of the strength of Member Constituents @ Re 2/- per member subject to a minimum of Rs. 2000/- even if its strength is less than 1000. The Subscription shall be due for the year on the first day of January of that year. It shall be paid in advance and in any case not later than 31st day of January of that year.
  • A Constituent enrolled at any time during the year shall pay the full subscription for that year irrespective of date of enrolment.
  • The Constituent having member strength more than 1000 but less than 1500 will have to pay a minimum of Rs. 3000/- as subscription likewise, a constituent having member strength more than 1500 but less than 2000 will have to pay a minimum of Rs. 4000/- as subscription and so on in the multiples of 500 member strength.
4 Travelling Allowance to the Members :
  • The Federation shall contribute from its funds one 3 A.C Class train fare each way to the Office bearers and any Special Committee / Sub-Committee / Adhoc Committee appointed by the Council / Executive Committee. When such Members are allowed any railway concession they shall be paid at the concessional rate.
  • Any person entrusted any work by the President or the Secretary General of AIFODE, will be entitled for T.A.
5 General Procedure of Meetings :
  • Minutes of all Meetings shall be correctly kept and shall be duly confirmed in the following Meeting of the Executive Committee or the Council as the case may be.
  • No resolution adopted or dropped at a meeting shall be reconsidered unless either 6 months have elapsed or 1/5th of the Members of the Council / Executive Committee sign a requisition for its reconsideration.
  • The Chairman shall in case of equality of votes, have a casting vote.
  • No Business shall be transacted at a special meeting other than for which the meeting is called.
  • A notice may be served on any member either personally or by post under certificate of posting.
6 Composition of the Journal Committee :
  • The Journal Committee shall consist of :
    1. President
    2. Editor
    3. Secretary General
    4. Sr. Vice President
    5. Addl. Gen. Secretary
    6. Finance Secretary
The duties and functions of the Journal Committee shall be decided by the Executive Committee as and when necessary.
7 Funds of the Federation :
  • Subscription from Central / State / Territorial / Local Constituents.
  • Central Fund Contribution (C.F.C) from Centre /State/ Territorial / Local Constituents as and when decided by the Executive Committee.
  • Special contribution and donations raised directly or through the Centre / State / Territorial Constituents as and when decided by the Executive Committee.
  • Income derived from the Journal and other publications of the Federation as per Bye-Laws.
  • Contribution received from the Centre / State/ Territorial Constituent organizing the All India Diploma Engineers Conference.
  • Interest on Deposits.
  • Rent etc, if any.
  • Such other sources as may be authorized by the Council / Executive Committee.
8 Expenditure :
  • The Executive Committee shall, out of the funds of the Federation, defray all ordinary expenses and shall pay rents, salaries, wages and such other charges as may be necessary for carrying on the work of the Federation.
  • It shall further provide for the issue of the Journal and such other publication as may be authorized and shall be empowered to spend money on Engineering investigation, Conference and for such other purposes as it may consider advisable in furtherance of the aims & objects of the Federation.
  • The A/c of the Federation shall be centralized and controlled by the President through office bearers such as Secretary General, Finance Secretary & the Editor.
  • There will be separate heads for Journal and Building etc in the main A/c Book and Budget etc.
  • The statement of Income & expenditure and balance sheet shall be consolidated for all the heads by the Finance Secretaries and shall submit their A/c for each quarter of the year before the E.C duly audited by the Auditor.
  • The A/c Books of the Federation shall be opened for inspection by the E.C Members on specific request with due notice for the time.
9 Duties and Powers of the Office Bearers :
President :

  • The President shall be constitutional Head of the Federation.
  • Shall be the Chairman of all meetings of the Council, Executive Committee and shall preside over any other Committees of which he is a member.
  • Shall guide and control the activities of the Federation and the Council.
  • Shall regulate proceedings of the Meetings and conferences, interpret the Rules and Bye-Laws and decide doubtful points.
  • President should have only a casting vote in case of equality of votes.
  • Shall be eligible to incur an expenditure upto Rs. 10,000/- in special circumstances subject to ratification by the Executive Committee.
  • Shall expedite various memberships of the Federation including AIDEJ etc.
  • Shall be Ex-officio member of all Committee.
10 Senior Vice President :
In absence of President, the Senior Vice President shall act as President in all respects. He will assist and render advice to the President and he will help the President in the matter relating to Foreign Countries (SDEF).
11 Vice Presidents (4 Nos) :
The Vice Presidents shall help in organizing the Federation by conducting tours, holding meetings, issuing letters etc. particularly in his Jurisdiction. He shall preside over the meetings of the Federation in absence of the President and Senior Vice President.
12 Secretary General :
Secretary General will be the Chief Executive of the Federation.
  • Shall conduct all correspondences.
  • Shall have general supervision of A/c, shall pass Bills for payments and sign cheques.
  • Shall have Power to incur the expenditure upto Rs. 5000/- for the specific cause of AIFODE.
  • Shall supervise Register, organize meetings, and expedite memberships including AIDEJ.
13 Additional General Secretary :
  • Shall be incharge of the Central Office and maintain all the records of the Federation in order.
  • Shall make correspondence as per general guidance of the Secretary General and help him in preparing agenda of the Meetings and all other official business e.g. recording of the proceedings of the meetings etc.
  • Shall maintain a permanent imprest of Rs.2000/- for meeting with office expenses.
14 Secretaries (4 Nos.) :
  • Shall help Secretary General in dealing with general problems of the members of their respective wings.
  • Shall organize their respective wings through mobilizing State level or Local Organizations and Service Associations.
15 Zonal Secretaries (8 Nos.) :
  • Shall help the Secretary General in organizing the Federal and in furtherance of the causes in their respective Zones as directed by the Secretary General.
  • Will conduct tours in their respective zones for organization matter.
Secretaries and other Zonal Secretaries will have to submit their Performance report in writing to every Executive Committee meeting.
16 Financial Secretary :
  • Shall receive all funds of the Federation and deposit them in a Schedule Bank or Banks approved by the Council to the credit of the Federation and operated jointly by the Finance Secretary and the Secretary General.
  • Shall be responsible for collection of all subscriptions and contributions due to the Federation.
  • Shall be responsible for keeping up-to-date account of the Federation with all the account books up-to-date.
  • Shall dispose off the bills for payment as approved by the Secretary General / Addl. Gen. Secretary.
  • Shall get the accounts audited by the Auditor.
  • Shall prepare consolidated accounts to be placed before Executive Committee Meeting.
  • Shall prepare annual accounts and a balance sheet showing the financial position of the Federation, duly audited by the Auditor and approved by the Executive Committee.
  • Shall prepare and place before the council for ratifications the Annual Budget for the next year in consultation with the Secretariate.
  • Shall undertake all correspondence for the realization of dues of the Federation under intimation to the Central Office and respective Secretaries / Zonal Secretaries and shall prepare ways and means to raise the Funds of the Federation.
  • Will get the bills/vouchers ratified by the E.C. exceeding Rs. 10,000/-
17 Editor :
  • Shall conduct; organize all the activities of the Journal of the Federation.
  • Shall be in-charge of editing, printing, publishing and circulation of the Journal.
  • Shall maintain Accounts in respect of receipt and expenditure of the Journal and place the Accounts before the Executive Committee and Council duly audited by the Auditor for approval.
  • Shall collect advertisements, printing materials, news about Federation and Member Constituents activities for publishing in the Journal.
  • Shall be responsible to the Federation for all the printed material in the Journal.
  • Shall maintain and be custodian of the Library Books and other Library material etc.
18 Auditor :
Auditor shall audit annually the accounts maintained by the Finance Secretary and the Editor and give his report to the E.C for being placed before the council.
19 Election of Office Bearers :
  • The normal tenure of Office Bearers being two years, the election of Office Bearers shall be held after every two year.
  • Mid term election shall be held if the Member Constituents by 2/3 majority so decide.
  • The election should take place in a rational procedure, so that the representations of most of the units are confirmed.
  • All the members of the Council shall be entitled for one vote each.
  • The Constituencies for Vice Presidents, Secretaries and Zonal Secretaries shall be confined to their respective wings and zones.

CODE OF ETHICS
[For Members of the All India Federation of Diploma Engineers]
Foreword
A Member should recognize the principles of honesty. Justice and courtesy to quide him on the practice of his profession and on his personal conduct. He should not merely observe them passively but should apply them dynamically to the discharge of his duties to the public and the profession.
He should scrupulously guard his professional reputaion and avoid association with any enterprise of questionable character. He should uphold the dignity and honour of the Engineering Profession.                                                       
THE CODE

  1. A Member will co-operate with others in his profession by the free exchange of information and experience and will contribute to the All India Federation of Diploma Engineers to the maximum effectiveness he is capable of.
  2. A Member will endeavor to protect the Engineering profession from misrepresentation and misunderstanding.
  3. A Member will take care that credit for Engg. work is given to those to whom credit is properly due.
  4. A Member will not permit his name to be used in connection with the advertisement.
  5. A Member will not directly or indirectly injure the professional reputation or practice of another Member
  6. A Member will exercise due restraint in criticizing the work of another member so that the proper forum for technical criticism in an Engineering Society or the press maintained.
  7. A Member will not try to oust another Member in a particular employment.
  8. A Member will not compete unfairly with another Member by charging fees below those customary for others in his profession practicing in the same field and in the same area.
  9. A Member will not associate in work with an engineer who does not conform to ethical practices.
  10. A member will act in professional matters for his client or employer as a faithful agent or a trustee.
  11. A Member will not misrepresent his qualifications to a client or employer or to the profession.
  12. A Member will not misrepresent his qualifications to a client or employer or to the profession.
  13. A Member will act with fairness and justice between his client or employer and the contractor when dealing with contracts.
  14. A member will not be financially interested in the bids of a contractor on competitive work for which he is employed as an Engineer unless he has the written consent of his client or employer.
  15. A Member will not receive any commission, discount or other indirect profit in connection with any work with which he is entrusted.
  16. A Member will immediately inform his client or employer of any interest in a profession which may compete with or affect the business of his client or employer.
  17. A Member will not allow an interest in any other business to affect the Engineering work for which he is employed or may be called upon to perform.
  18. A Member will engage or advise engaging Engineering experts and specialists when in his judgment such services are to the interests of his client or employer.
  19. A Member will not review the work of another Member for the same client, except with the knowledge of the second Member, unless such engineering engagement or the work which is subject to review is terminated.
  20. A Member will not accept financial or other compensation from more than one interested party for the same service or for services pertaining to the same work, without the consent of all the interested parties.
  21. A Member will subscribe to the principle of appropriate and adequate compensation for those engaged in engineering work including those in subordinate positions.
  22. A Member will endeavor to provide opportunity for the professional development and advancement of Engineers in his employment.
  23. A Member will, if he considers that another Member is guilty of unethically illegal or unfair practice present the information to the Council of the ALL INDIA FEDERATION OF DIPLOMA ENGINEERS for action.
  24. A Member who is engaged in engineering work will order his conduct according to the professional standards and customs adhering as closely as he is practicable, to the principles of this Code.
